Visitor Visa

A Temporary Resident Visa (TRV), also referred to as a visitor visa or Canada Tourist visa, is an official document issued by a Canadian visa office that is placed in your passport to show that you have met the requirements for admission to Canada as a temporary resident (either as a visitor, a student, or a worker).

Canada is home to millions of visitors each year. In fact, more than 35 million people visit Canada every year to enjoy the many opportunities our country has to offer, including visiting family and friends. If you wish to come to Canada for a temporary purpose like a vacation, or to visit family or friends, you may need a Temporary Resident Visa, unless you are a citizen from a “visa exempt” country like the USA or Australia.

Super Visa

The Parent and Grandparent Super Visa is a popular Canadian immigration visa, with over 1000 Super Visas being issued each month. Super Visas allow parents and grandparents to enter and leave Canada as many times as they want, for up to 10 years, while also having the option to stay in Canada for up to 2 years at a time. As mentioned, the Super Visa eliminates the need for parents and grandparents to reapply for a Temporary Resident Visa each time they come to Canada and also eliminates the need for visitor status renewal during extended periods of visitation in Canada.

Those interested in applying under the Super Visa program must be able to demonstrate their host (i.e. son, daughter, grandson, or granddaughter) meets the minimum income level, and that the applicant has acquired comprehensive Canadian medical insurance and passed a medical examination.

CANADA PROVINCIAL NOMINEE PROGRAM (PNP) DETAILS
The Canada Provincial Nominee Program was created to attract skilled international talent to Canada provinces facing a talent shortage. Thousands of successful applicants have relocated and permanently settled in Canada through the PNP program. Some of the best Canadian provinces to apply to under this program are:

Paper based process

The first step is to apply to the province or territory for nomination under the non-Express Entry stream. If you meet the eligibility requirements and qualify through the individual In-demand Occupation Lists of some provinces, you will get a nomination from the province if your occupation is on the list. You can then apply for a Canada PR Visa. You will now have to submit a paper application for your PR visa. The processing time is usually longer than through the Express Entry system.

Express Entry System

You can apply for a nomination by contacting the province or territory and apply for a nomination under the Express Entry stream. If you get a positive response from the province or territory to nominate you, you can create an Express Entry profile or update your profile if it already exists.

The other option is to create an Express Entry profile and indicate the provinces or territories you are interested in. If the province sends a ‘notification of interest’ you can then contact them and then apply through the Express Entry system. You must meet the eligibility requirements for a successful outcome of your application.

Immigration Appeals

​​The Immigration Appeal Division (IAD) of the Immigration and Refugee Board of Canada (IRB) hears appeals on immigration-related matters. There are several types of appeals that are heard by the IAD:

  • Appeals of family class sponsorship applications refused by officials of Immigration, Refugees and Citizenship Canada (IRCC).
  • Appeals of removal orders made against permanent residents, Convention refugees and other protected persons, and holders of permanent resident visas.
  • Appeals by permanent residents who have been found by an IRCC official outside of Canada not to have fulfilled their residency obligation.
  • Appeals by the Minister of Public Safety of decisions at admissibility hearings by the IRB’s Immigration Division (ID) where the ID made a decision that a person is not inadmissible.

The IAD may allow an appeal and set aside an original decision based on the grounds of an error in law or fact, or of a breach of a principle of natural justice. In certain cases, the IAD may also give special relief on the basis of humanitarian and compassionate considerations, which includes taking into account the best interests of a child directly affected by the decision being appealed to the IAD. In a removal order appeal, the IAD may also give special relief by staying the removal order with conditions. If the IAD does not allow an appeal or stay the removal order made against the appellant, the IAD will dismiss an appeal.

Family Sponsorship

Spousal and Family Sponsorship

When you immigrate to Canada, you do not want to come alone. With the Spousal and Family Sponsorship Class, you do not have to. This Sponsorship Class was created by the Canadian government, to help reunite families whenever possible. If you are a permanent resident or Canadian citizen, you could qualify to sponsor certain members of your family to immigrate to Canada with you. There are several categories that can help unite you and your loved ones.

Parents and Grandparents Sponsorship

This program allows parents and grandparents to apply for permanent residence in Canada, and later conceivably earn Canadian citizenship, if they meet all requirements set by IRCC. Potential sponsors must submit documents online in order to qualify as one of the 10,000 sponsors that are invited to apply for this sponsorship.

Dependent Child Sponsorship

This sponsorship applies to both adopted and natural born children, so long as both sponsors and children receive approval from IRCC. The Dependent Child Sponsorship gives candidates the chance to become permanent residents and to study and work in Canada.

Spousal and Common-Law Partner Sponsorship

A permanent Canadian resident or citizen may sponsor their non-Canadian spouse or common-law partner after they have been approved by the IRCC. Candidates in same sex relationships are also considered by the Canadian government. Sponsorships can be through the Outland or Inland Sponsorship.
